Client Service Agreement
Effective October 10, 2026
This agreement is between Hometown Web Co. ("we") and the business that accepts it ("you"). You accept it by signing, by clicking to accept, or by paying your first invoice after approving your mockup. It applies to all paid work.
1. What we'll do
We'll design, write, build, and host a website for your business (the "Site"), set up your Google Business Profile if you want, and make the edits your plan includes. The Site includes up to 10 pages unless we agree in writing to more. Online stores, online ordering systems, and custom software are quoted separately.
2. Mockup and approval
We'll send a free homepage mockup. You owe nothing unless you approve it in writing (email is fine). After approval, we'll finish the remaining pages and send them for review. You get two rounds of changes before launch. We aim to launch about 7 days after approval, but timing depends on how quickly we receive your content and feedback.
3. Plans and fees
Monthly plan: $149 per month. The first charge is made at launch. There is a 12-month minimum term. After 12 months, the plan continues month to month until either of us cancels with 30 days' written notice.
Own it plan: $1,800 one-time, with 50% due when you approve the mockup and 50% at launch, plus $39 per month for hosting and care starting at launch, cancelable any time with 30 days' notice.
Fees are charged automatically to the card or bank account you give us through Stripe. If a payment fails, we'll tell you and give you 14 days to fix it before we may pause the Site. Prices for a future term may change with 60 days' notice. Fees don't include taxes, which we'll add where required.
4. Canceling during the minimum term
If you cancel the Monthly plan during the first 12 months, you can either pay the remaining months of the minimum term or end the agreement by paying the buyout amount in section 6. If we materially fail to provide the service and don't fix it within 30 days of your written notice, you may cancel with no further fees.
5. Your responsibilities
- Give us accurate information about your business, including licenses, prices, and hours.
- Only send us photos, logos, text, and other materials you own or have permission to use. You're responsible for them, and you'll cover our costs if they lead to a claim against us.
- Make sure the claims on your Site about your business are true and that your business follows the laws that apply to it.
- Review drafts and reply within a reasonable time.
6. Ownership
Your content (your logo, photos, text, and business information) always stays yours.
Your domain name is registered in your name, and you keep it if the agreement ends. We'll give you the login or transfer it on request.
The Site's design and code. On the Own it plan, you own the finished Site once paid in full. On the Monthly plan, we own the design and code and license them to you while the plan is active. You can buy the Site outright at any time for $1,800 minus the monthly fees you've already paid, with a minimum of $500. If the plan ends without a buyout, we'll take the Site down and give you a copy of your content within 30 days.
We may show the Site in our portfolio unless you ask us not to.
7. Hosting, edits, and support
We host the Site on reputable providers and aim to keep it online, but we can't guarantee uninterrupted availability. Monthly plan edits include small updates such as hours, prices, text, and photos, typically completed within one business day. Larger changes, such as new pages or redesigns, may be quoted separately. We keep regular backups.
8. Third-party services and stock images
Where we use stock images, fonts, or tools, we use properly licensed ones and the license terms apply. Third-party services (such as Google, booking tools, or payment providers) are governed by their own terms, and we aren't responsible for their outages or changes.
9. Results
We'll build a professional, fast, mobile-friendly Site and set up the local search basics. We can't guarantee search rankings, traffic, leads, or revenue.
10. Confidentiality
We'll keep your non-public business information confidential and use it only to provide our services.
11. Warranties and liability
We'll perform our work in a professional manner. Otherwise, the services are provided as is, to the extent the law allows. Neither of us is liable to the other for indirect or consequential damages, including lost profits. Our total liability under this agreement is limited to the fees you paid us in the 12 months before the claim.
12. Ending the agreement
Either party may end this agreement if the other materially breaches it and doesn't fix the breach within 30 days of written notice. Sections 5, 6, 10, 11, and 13 continue after the agreement ends.
13. General
This agreement is governed by the laws of the state in which Hometown Web Co. is based. Disputes will be handled in the courts serving the county where Hometown Web Co. is based, after both parties try in good faith to resolve them informally for 30 days. Changes must be in writing and agreed by both parties. If part of this agreement can't be enforced, the rest still applies. This agreement and your approved quote or plan selection are the entire agreement for the work.
